How overtime pay is calculated

  1. Overtime rate = hourly rate × 1.5 ("time and a half"). $20 an hour becomes $30.
  2. Overtime hours = hours worked in the week − 40 (the federal FLSA limit). 45 hours means 5 overtime hours.
  3. Gross pay = 40 × rate + overtime hours × overtime rate. 45 hours at $20: $800 + $150 = $950 before taxes.
  4. Double time hours (for example California's hours past 12 in a day) are paid at 2× and taken out before weekly overtime, so no hour is paid twice.

$7.25 is the federal minimum wage. Many states and cities have a higher minimum.

Who gets overtime?

Under the federal Fair Labor Standards Act, most hourly employees must get at least 1.5× their regular rate for hours over 40 in a workweek. Salaried employees can be exempt if they meet the duties and salary tests. Some states go further: California, Alaska and Nevada add daily overtime, and California pays double time after 12 hours in a day. The time card calculator applies those daily rules to each day of your week.

The regular rate includes most bonuses and shift differentials, so overtime on those is owed too; this calculator assumes a single hourly rate. Check your state labor department or your pay stub if a number looks wrong.

FAQ

Does overtime count per day or per week?

Federally, per week: only hours past 40 in a fixed 7-day workweek. A 10-hour day in a 38-hour week is not overtime under federal rules (it is in California).

Do paid holidays and sick days count toward 40 hours?

Not under the FLSA: only hours actually worked count, unless your employer or contract says otherwise. To see how much paid time off or sick leave your hours earn, use the PTO accrual calculator.

What is my hourly rate if I'm on a salary?

Divide your yearly salary by 2,080 (40 hours × 52 weeks): $50,000 a year is $24.04 an hour, so time and a half is $36.06. The salary to hourly calculator does it for any hours, and adds a week's overtime to your yearly pay.

Is overtime taxed more?

No. Overtime is ordinary wages. A bigger paycheck can have more withheld, but the tax rate on your income for the year is the same.

What is the "no tax on overtime" deduction?

For tax years 2025 through 2028 you can deduct the overtime premium the FLSA requires from your federal taxable income: the "half" in time and a half for hours past 40 in a workweek, not the whole overtime check. At $20 an hour, 5 overtime hours pay $150 but $50 is deductible (the calculator above shows it as the "No tax on overtime" deduction; for a whole year with the cap and phase-out, use the no tax on overtime calculator). The limit is $12,500 a year ($25,000 filing jointly), reduced once modified AGI passes $150,000 ($300,000 jointly). You need an SSN, married couples must file jointly, and you claim it whether or not you itemize.

What doesn't count: overtime only state law requires (California's daily overtime and double time), anything above 1.5× that your employer pays by choice or contract, and pay of FLSA-exempt employees. Overtime is still taxed for Social Security and Medicare, and withheld as usual; state income tax follows state law. From 2026, employers report qualified overtime separately on your W-2.
